The Conversation

Why do records decide injury cases?

Insurance carriers do not pay for what happened to you — they pay for what can be proven. Medical records, incident reports, and photographs are the evidence an adjuster, a judge, or an arbitrator actually reads. This episode is about why the paper trail, not the story, so often sets the value of a case.

What does a gap in treatment tell the insurance company?

When weeks pass between the injury and the first doctor visit — or between visits — carriers argue you must not have been that hurt. Consistent, documented medical care is one of the strongest signals a claim can send, and one of the easiest things injured people unknowingly get wrong.

What should you document from day one?

Photos of the scene and your injuries, names of witnesses, the incident or police report, and every medical appointment. Report a work injury to your employer right away and make sure it is written down. None of it feels urgent in the moment — all of it matters months later.

How does Marker Law use documentation to push back?

Jason spent his early career on the insurance defense side, so he knows exactly which records carriers look for and how they use gaps against you. Building the record properly from the start is how a case gets valued the right way — listen to the full episode for the way he walks through it.
