An injury that permanently impairs the ability to earn a living or function independently. Common examples: severe TBI, spinal cord injury with paralysis, amputation, third-degree burns over significant body area, blindness.

The number has to include life-care planning — decades of medical care, therapy, equipment, attendant services, home modifications, lost earning capacity, and the human damages of loss of normal life.

The personal representative of the estate files the action on behalf of the surviving spouse, children, and other next of kin. Marker Law handles the probate setup as part of the engagement.

Two years from the date of death in most cases, with some exceptions. Claims involving criminal acts or government defendants follow different timelines — call right away.
